Hawaii House bill HB1841, 23rd Legislature 2006

Report Title: Hazardous Waste; Waste-Derived Fertilizer
Description: Prohibits the Department of Health from adopting any rule related to the disposition of waste-derived fertilizers (including 40 C.F.R. §266.20) that is less stringent than the Resource Conservation and Recovery Act of 1976 and the Hazardous and Solid Waste Amendments of 1984.

Hawaii Senate bill SB2679, 23rd Legislature 2006

Report Title: Recyclable Materials; Hazardous Waste Use; Regulation
Description: Requires DOH to adopt rules to regulate hazardous waste-derived products, including recyclable materials. Establishes a temporary prohibition on the manufacture and import into the State of hazardous waste-derived products until the rules are adopted. (SB2679 HD1)

Hawaii House bill HB941, 20th Legislature 1999

REPORT TITLE: Waste-derived fertilizers
DESCRIPTION: Prohibits the importation into the State of any commercial fertilizer that does not meet the allowable levels of nonnutritive metals in commercial fertilizers as specified in the Canadian Fertilizers Act, as amended. (HB941 HD1)

Idaho House bill HB681, 57th Legislature 2004

FERTILIZER - Adds to and amends existing law to prohibit local regulation and legislation relating to fertilizers.
Note: Local communities are most likely to pass ordinance against waste-derived fertilizer use. Therefore, industry pushes preemption bills like this one claiming the need to maintain consistent labels or packaging across a state or between states.

Nebraska Senate bill LB 1243 - 98th Legislature 2004, 2nd session

Report Title: COMMERCIAL FERTILIZERS
LB 1243 was introduced by Senator Preister to gather data to determine which substances are contained in the commercial fertilizers and soil conditioners
that are sold and distributed in Nebraska. This will enable the state to determine whether or not there is a problem in Nebraska with wastederived products or controlled substances being added to commercial fertilizers and soil conditioners which are sold and distributed in Nebraska.
LB 1243 would require labels and labeling of commercial fertilizers and soil conditioners so that consumers have information regarding the substances
that are contained in the products they purchase.
The semi-annual reports would also need to be filed by every person who distributes commercial fertilizers and soil conditioners and must set forth,
by county name, the number of tons of each commercial fertilizer or soil conditioner sold.

Hawaii Senate bill SB1037/SB33, 24th Legislature 2007

Report Title: Fertilizer; Health; Hazardous Substances
Description: Requires the department of health to establish a labeling program that establishes more stringent standards than the current U.S. Environmental Protection Agency and Association of American Plant Food Control Officials standards. Limits imports of fertilizers to those that meet the more stringent standards.

 

As of 2/27/07 this bill had been deferred by both the Senate ENE and HTH committees.
